Cypress announces Nokia Siemens Networks has been released from ITC complaint regarding SRAM patent infringement by GSI

SAN JOSE, USA: Cypress Semiconductor Corp. announced that it has come to terms with Nokia Siemens Networks on an agreement that will remove that company from Cypress’s complaint to the United States International Trade Commission (ITC) regarding the alleged infringement of Cypress’s SRAM patents by GSI Technology, Inc.

Cypress’s complaint seeks an exclusion order from the ITC that will prevent the importation of all infringing GSI SRAMs. The ITC action against GSI lists known importers of products that incorporate potentially infringing GSI SRAMs.

“We’re pleased to reach agreement with Nokia Siemens Networks on this matter, effectively removing another customer from this case,” said Dana Nazarian, executive VP of Cypress’s Memory Products Division. “Our intention has never been to burden customers with this action. However, GSI Technology’s unwillingness to acknowledge and rectify its infringement of our intellectual property has left us with no alternative.

“Despite misleading reports to the contrary, the four Cypress patents that GSI has infringed are still valid and are proceeding for an expected ruling by the ITC in 2012,” Nazarian added. “Any actual ruling on the review of the two patents that are in re-exam with the United States Patent and Trademark Office isn't expected until 2013, long after the ITC case is decided. We firmly expect to see our patents re-affirmed by that process, but it will have no impact on this action in either case.”
